No need of prior approval of jurisdictional AC / DC for duty-free imports by EOU, clarifies CBIC

The Central Board of Indirect Taxes & Customs vide Circular No. 10/2018-Customs dated April 24, 2018 has clarified that for making Import at concessional rate of duty by EOUs, submitting information as required under Rule 5(1)(a) of Customs (Import of Goods at Concessional Rate of Duty) Rules, 2017 (“Rule”) viz. estimated quantity and value of goods to be imported, to the DC/AC of Customs at the Custom Station of importation is sufficient.

Accordingly, it has removed the misconception arising out of wrong interpretation of Rule 5(3) of said rule by stating that the provision nowhere makes the forwarded copy by jurisdictional DC / AC to DC/AC of Customs at the Custom Station a prerequisite for allowing duty-free import by DC / AC at Customs Station of importation.
