Appoint nodal officer for timely GST refunds

In order to fix the issue of processing GST refunds on time, the taxation professionals are now demanding appointment of a nodal officer for refund cases at division level. Recently a delegation of the Punjab Tax Bar Association (PTBA) and District Taxation Bar Association (DTBA) met Ashutosh Baranwal, principal commissioner, Central GST commissionerate (CGST), Ludhiana and apprised him of other issues faced by them. President of PTBA Bal Krishan Gupta said, “Problem of delay in the GST refunds is not coming to an end and the taxpayers and tax professionals are having a tough time combating this. Therefore, there is requirement of a nodal officer for refund cases at division level and GST registration branch in all district level. Despite several steps taken by the government, various hardships are still being faced by the tax professionals, trade and industry as well. GST laws state that there is one nation one tax, all the enforcing authorities under the GST whether of Central government or of state government have gained parity so the judgement of any high court is bound to be followed throughout the country.

But the authorities have failed to adopt the same judgements of other states claiming that they are applicable only in the states where the judgement was pronounced.” Secretary general of PTBA BR Kaushal said, “Officers in different divisions of GST Ludhiana act differently while dealing with refund files. We have brought this to the knowledge of principal commissioner and urged him to assure that uniform system should be adopted by all the officers in all the divisions to avoid undue harassments to the applicants and further a checklist be provided for submission of documents in the refund cases. We have requested that the refund files should be cleared at the earliest and refund payments should be made within the stipulated time. We have got a positive response from the principal commissioner who has assured us that all our demands including appointment of a nodal officer will be taken into consideration and action will be taken as soon as possible”
